1. About these Terms
These Terms of Service ("Terms") form a legally binding agreement between you ("you", "user") and Poonthottathil Gardenz Fresh LLP ("PGF LLP", "we", "us", "our") — a Limited Liability Partnership incorporated in India on 18 November 2021 under the LLP Act 2008, LLPIN AAZ-5387, registered with the Registrar of Companies, Ernakulam (Kerala). Recognised by the Department for Promotion of Industry and Internal Trade (DPIIT), Government of India under Startup India certificate DIPP124938 (valid until 17 November 2031). Registered office: Room No. 6/477Q, Rahmath Nagar, Edayur Post, Malappuram, Kerala 676552, India.
"Platform" means the West Velocity website at west-velocity.com, the Social Hub, the Strovolt brand site, the MarknStamp brand pages, our mobile applications, and any subdomain or service we operate. Strovolt is a brand owned and operated by PGF LLP.
These Terms are published in compliance with Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules 2021") under the Information Technology Act 2000, and the Consumer Protection (E-Commerce) Rules, 2020. By accessing the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Community Guidelines, and any policy referenced herein. If you do not agree, you must stop using the Platform.
2. Eligibility & account registration
- You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872. Users between 13 and 18 may use the Platform only under the supervision of a parent or legal guardian who agrees to these Terms on their behalf.
- You agree to provide true, accurate, current, and complete information during registration and to keep it updated.
- You are responsible for safeguarding your password and for all activity under your account. Notify us immediately at info@west-velocity.com of any unauthorised use.
- One person or legal entity may not maintain multiple accounts to evade enforcement actions or manipulate the Platform.
- We may refuse, suspend, or terminate accounts at our reasonable discretion, especially where verification fails or these Terms are breached.
3. Licence to use the Platform
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform for your own lawful, personal, and (where applicable) business purposes. You may not:
- Copy, reproduce, modify, reverse engineer, decompile, or create derivative works of any part of the Platform;
- Use bots, crawlers, scrapers, or any automated means to access, harvest, or extract content (except as permitted by our
robots.txt); - Resell, sublicense, or commercially exploit the Platform other than through features we expressly provide (e.g., the seller marketplace);
- Bypass rate limits, access controls, paywalls, geo-restrictions, or any technical protection measures;
- Use the Platform in any way that could damage, disable, or impair the service or interfere with other users.
4. User content & the Social Hub
The Social Hub lets you create posts, stories, reels, comments, messages, group content, events, product listings, profile photos, and other material ("User Content"). You retain ownership of your User Content. By posting on the Platform you grant PGF LLP a worldwide, royalty-free, non-exclusive, sublicensable, transferable licence to host, store, reproduce, adapt, translate, distribute, publicly display, and create derivative works of your User Content for the purposes of operating, promoting, and improving the Platform — including in marketing, search-engine snippets, recommendation feeds, and partner channels — for as long as your account is active and for a reasonable period thereafter to comply with backups and legal retention.
You represent and warrant that:
- You own your User Content or have all rights and permissions necessary to grant the above licence;
- Your User Content does not infringe any third-party right (copyright, trademark, privacy, publicity, or otherwise);
- Your User Content does not violate any applicable law or these Terms.
We are an "intermediary" as defined under Section 2(1)(w) of the IT Act 2000. We do not initiate, select the receiver of, or modify the information contained in User Content. Liability for User Content lies with the user who posted it.
5. Prohibited content & conduct

- Belongs to another person and to which you do not have any right;
- Is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating to or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
- Is harmful to a child;
- Infringes any patent, trademark, copyright, or other proprietary right;

The full list of prohibited content and behaviour, including community standards, is set out in our Community Guidelines, which form part of these Terms.
6. Purchases, orders & payments
The Platform hosts an online marketplace through which independent third-party sellers list goods and services. When you place an order, you enter a contract directly with the seller for the supply of those goods or services. PGF LLP acts as an intermediary that facilitates discovery, communication, payment processing, and fulfilment tracking.
- Prices, taxes (GST/VAT), shipping fees, and delivery timelines are displayed before checkout. You agree to pay the full amount displayed at order confirmation.
- Payments are processed through licensed payment service providers (Razorpay, Stripe, and other PCI-DSS compliant gateways). We do not store full card numbers or CVVs.
- Returns, refunds, cancellations, shipping, and delivery are governed by our Returns & Refunds Policy, Shipping & Delivery Policy, and Cancellation Policy.
- For e-commerce-related grievances under the Consumer Protection (E-Commerce) Rules, 2020, contact our Grievance Officer (see §16).
7. Third-party services & sellers
The Platform may contain links to third-party websites, services, or content (including seller storefronts, payment gateways, shipping carriers, advertisements, and analytics tools). We do not control and are not responsible for the practices of these third parties. Your use of third-party services is subject to their own terms and privacy policies.
Sellers on the marketplace are independent businesses bound by our Seller Terms & Conditions and Seller Code of Conduct. PGF LLP is not the seller of, manufacturer of, or warrantor for goods listed by third-party sellers, except where a product is expressly listed as sold and dispatched by PGF LLP / Strovolt / MarknStamp directly.
8. Intellectual property
All rights in the Platform — including software, design, trademarks, logos, the names West Velocity, Strovolt, MarknStamp, Gardenz Fresh, all related taglines and stylised marks, page layouts, graphics, code, and aggregated content — are owned by or licensed to PGF LLP and are protected by Indian and international intellectual property laws. Nothing in these Terms transfers ownership of any IP to you.
You may not use any PGF LLP mark, logo, or copyrighted material without our prior written permission, except for fair use such as nominative reference (e.g., a news article identifying the Platform).
9. Takedown & grievance redressal
If you believe content on the Platform infringes your rights or violates these Terms, file a complaint via:
- Email: grievance@west-velocity.com or info@west-velocity.com
- The full procedure is set out in the Grievance Redressal Policy and the IP & Copyright Takedown Policy.
We will acknowledge complaints within 24 hours and resolve them within 15 days, in accordance with Rule 3(2) of the IT Rules 2021. Complaints relating to content of a sexual nature, impersonation, or non-consensual imagery will be acted on within 24 hours per Rule 3(2)(b).
10. Privacy & data
Our collection, use, storage, and protection of personal data is governed by the Privacy Policy, which complies with the Digital Personal Data Protection Act 2023 (DPDP Act). By using the Platform, you consent to the data practices described in the Privacy Policy.
11. Suspension & termination
We may suspend or terminate your access at any time, with or without notice, for any breach of these Terms, suspected fraud, illegal conduct, repeated user complaints, or as required by law or court order. You may close your account at any time from the account settings page or by writing to info@west-velocity.com. Sections that by their nature should survive termination (IP, indemnity, liability, governing law) will continue to apply.
12. Disclaimers & limitation of liability
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses, or that any content (including User Content posted by others, prices, descriptions, and seller information) is accurate, complete, or current.
To the maximum extent permitted by law, PGF LLP, its designated partners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profit, revenue, goodwill, business opportunity, or data — even if advised of the possibility. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the total amount you paid to PGF LLP in the twelve (12) months preceding the claim, or (b) INR 5,000.
13. Indemnity
You agree to defend, indemnify, and hold harmless PGF LLP, its designated partners, employees, and affiliates from and against any claim, demand, loss, damage, liability, cost, or expense (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use of the Platform in breach of these Terms; (c) your violation of any law or third-party right; or (d) any goods or services you sold via the marketplace.
14. Governing law & disputes
These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to conflict-of-laws principles. Subject to the arbitration clause below, the courts at Malappuram, Kerala shall have exclusive jurisdiction.
The parties shall first attempt to resolve any dispute amicably within 30 days of written notice. If unresolved, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English by a sole arbitrator agreed by the parties, with the seat and venue at Kerala, India. The arbitrator's award shall be final and binding.
Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief in the appropriate courts of competent jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will be revised. Material changes will be notified by email to registered users at least 14 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
